Educational Leave (Berliner Bildungsurlaubsgesetz vom 17. Mai 1999)

All employees are entitled to additional educational paid leave. Educational leave is permitted for ten working days within a period of two consecutive calendar years. Until the age of 25, employees are entitled to educational leave amounting to ten working days per calendar year.

This leave is reduced for student assistants working less than five days a week. First-time requests can be submitted after six months (after the start of the contract) to participate in recognized political and professional continuing education courses. Requests for educational leave are submitted directly to Human Resources (go to application), whereby the supporting evidence of the course and its recognition as “suitable for educational leave” must be included.

Approval from the employee’s supervisor/direct workplace is not required.

However, it is advisable to inform them when submitting your request.

Employee Status

Student employees are public service employees (ÖD).

Employer (employment contract)

Officially, the president of TUB is your “employer”. The Department of Human Resources acts on his behalf. The Department of Human Resources usually follows the request of your superiors.

Employment Contract

After the Staff Council for Student Assistants has approved the request to hire you, TU Berlin will call or write you, requesting that you come in to sign your employment contract with the Department of Human Resources. You will receive a copy of the signed contract. You may only begin work after signing your employment contract. Your conditions for employment (collective wage agreement, fixed-term, working hours, pay, obligation to non-disclosure) are all laid out in the employment contract. You are responsible for reviewing the content of the contract. Carefully read through the contract before signing and contact us if anything is unclear. The University often just lists a certain faculty or institute as your place of work in order to flexibly deploy you where and if necessary.

Employment Reference (Section 14 TV Stud III)

You are entitled to an employment reference. As the president of TU Berlin is always the official employer of student assistants, you should request an employment reference from your respective personnel team which should then be signed by your supervisor. Generally, this is the head of the academic chair. The reference is then added to your personnel file which is subsequently closed. Appeals against a bad reference are also submitted via the personnel team to the department and are filed. We can provide assistance if you experience difficulties having any changes made. The advantage of this process, is that the personnel team is responsible for issuing a reference and the appeal deadline. The Staff Council for Student Assistants is only included in case of an appeal.

Pursuant to the new collective wage agreement, employment references are to be automatically issued at the end of employment. We recommend that you follow up however, as you are only entitled to a reference up to 6 months after the end of employment.

Exam Grading

Pursuant to Section 32 (2) BerlHG, exams may only be graded by persons who possess the qualification or equivalent gained by passing the exam. Examiners are University professors, academic staff with a Habilitation, and contract teachers. As student assistants are not part of any of these groups, they are not authorized to grade exams.

Pursuant to the circular dated 28.02.2018, however, student assistants may pre-grade exams under the instruction and supervision of an authorized examiner. We have commissioned the responsible Senate Administration to conduct a legal review of the legality of the law.

Exam Proctoring

Student assistants can serve as exam proctors in exceptional cases. In such a case, it is to be ensured that the student assistant can answer any technical questions or that someone who can is available nearby.

Additionally, it is to be ensured that an examiner authorized to make a decision about exclusion from an exam is available in the event of cheating or misconduct.

External Funding Projects

The regulations for student employees funded by the TU budget apply to those funded by external funding projects – with a few exceptions (particularly as regards duration of employment dependent on external funding or project duration).
