Paid Leave

You may be granted paid leave for the following; you are not required to make up the work:

  • Approved special leave (e.g. participation in a staff assembly pursuant to Section 48 PersVG, in university days, etc.)
  • Different religious holidays (by application if required)
  • University or state exams for the duration of an unavoidable necessary absence (Section 11 TV Stud III)
  • Further reasons in accordance with Section 11 TV Stud III include:

a) birth of a child: 1 working day for partner

b) death of a spouse, child, or parent: 2 working days

...

e) severe illness – including “of a child which has not yet turned 12 (...)” up to 4 working days

f) medical treatment, when it “(...) must take place during working hours”: proof of treatment + commute

g) time off on 24.12. and 31.12. each year when there is no official requirement to be present. Otherwise compensatory time off is to be granted instead within three months.

Parental Allowance and Parental Leave

Parents have the option of taking up to three years of parental leave and receiving a parental allowance for the first 14 months after the birth of their child. One parent is entitled to a maximum of 12 months leave; the remaining two months are allocated to the child’s other parent if this parent also cares for the child part-time. Parents caring for a child receive at least 67% of their net pay if they take a leave. A minimum of EUR 300 and maximum of 1800 EUR are disbursed. For former income under EUR 1000, parents receive - based on a particular calculation - more than 67%. For a 40-hour contract, parents receiving the parental allowance - depending on the social contribution fees to be paid - receive between 95 and 100 percent of their previous income (usually the full amount). Any plans to take parental leave must be communicated to your employer. If there is a ban on dismissal during maternity protection periods (Maternity Protection Act - Mutterschutzgesetz), protection against dismissal applies during parental leave, which can only be challenged in very rare cases.

Pension Fund

If you earn more than EUR 450 per month (below EUR 450 only the employer has to pay pension insurance contributions) you are liable for pension insurance contributions. Short-term employment is excluded from this. This includes employment lasting no longer than two months within a calendar year after a contract has been concluded (for a five-day week) or no longer than 50 days. For minor and short-term employment relationships, several employment relationships may be added together, which may result in an obligation to pay contributions. The pension insurance contribution is always paid in short-term employment relationships at TU Berlin.

Student assistants can submit a request to the health insurer to have this contribution returned, if they actually did not have any other employment that year. The pension insurance contribution is currently 18.7% (last updated: 12/2015) of your gross pay, with the employee paying half. If you earn between EUR 450.01 and EUR 850 (limits as of 2013) in your employment relationship, you can request reduced pension insurance contributions (Sliding Contribution Scale).

Personnel File (Section 3 TV Stud III)

When you enter public service, a personnel file is created for you that is also passed on within public service. It is managed by Human Resources and contains all information and events relevant to your employment. These events are numbered consecutively. You are entitled to view your file or authorize another individual in writing to do so.

You are permitted to take notes or make copies.

The file may only contain events you are aware of. If the file contains unfavorable allegations or complaints, you can raise an objection for which a hearing must be held. Both the objection and subsequent hearing are to be recorded in the file.

Your direct place of employment (e.g. your academic chair) is not permitted to keep files on you.

Probationary Period (Sections 2, 13 TV Stud III)

The first three months of employment are also a probationary period. The notice period during this time is only two weeks by month’s end. The probationary period is not repeated in the event of a contract extension or renewal.

Public Holidays

You are not required to work on a public holiday even if you were originally scheduled to do so. You are not required to make up this work. An exemption from work for different religious holidays can be granted on request according to your religious affiliation.
